Value Co-Creation plays a major role in engaging knowledgeable individuals in a community via innovation, problem solving, and new service/product development. This study investigates the personal factors that influence individuals’ engagement in value co-creation in Higher Education Institutions through the use of online platforms. Some higher education institutions have successfully established or used appropriate online platforms, such as online forums, web applications, and mobile applications to engage their community in ideation or crowdsourcing as a part of the value co-creation process. On the other hand, some HEIs have failed to engage their community in value co-creation activities, and even if they managed to engage some individuals in value co-creation once, they failed to sustain these individuals’ engagement in value co-creation using online platforms. Using the Stimulus Organism Response framework, this study examines the relationship between relevant personal factors and other motivational factors that provide perceived benefits with value co-creation engagement. Data was collected from 308 respondents at five Malaysian research universities. The software analysis tool Smart PLS is used for data analysis and validation. The results demonstrate that personal factors and perceived benefits as a motivational factor has a significant effect on individual engagement in value co-creation. Accurate and reliable prediction of Perfobond Rib Shear Strength Connector is considered as a major issue in the structural engineering sector. Besides, selecting the most significant variables that have a major influence on PRSC in every important step for attaining economic and more accurate predictive models, this study investigates the capacity of deep learning neural network for shear strength prediction of PRSC. The proposed DLNN model is validated against support vector regression, artificial neural network, and M5 tree model. In the (...) second scenario, a comparable AI model hybridized with genetic algorithm as a robust bioinspired optimization approach for optimizing the related predictors for the PRSC is proposed. Hybridizing AI models with GA as a selector tool is an attempt to acquire the best accuracy of predictions with the fewest possible related parameters. In accordance with quantitative analysis, it can be observed that the GA-DLNN models required only 7 input parameters and yielded the best prediction accuracy with highest correlation coefficient and lowest value root mean square error. However, the other comparable models such as GA-M5Tree, GA-ANN, and GA-SVR required 10 input parameters to obtain a relatively acceptable level of accuracy. Employing GA as a feature parameter selection technique improves the precision of almost all hybrid models by optimally removing redundant variables which decrease the efficiency of the model. We provide a critical assessment of the ambiguity aversion literature, which we characterize in terms of the view that Ellsberg choices are rational responses to ambiguity, to be explained by relaxing Savage's Sure-Thing principle and adding an ambiguity-aversion postulate. First, admitting Ellsberg choices as rational leads to behaviour, such as sensitivity to irrelevant sunk cost, or aversion to information, which most economists would consider absurd or irrational. Second, we argue that the mathematical objects referred to as “beliefs” in the ambiguity (...) aversion literature have little to do with how an economist or game theorist understands and uses the concept. This is because of the lack of a useful notion of updating. Third, the anomaly of the Ellsberg choices can be explained simply and without tampering with the foundations of choice theory. These choices can arise when decision makers form heuristics that serve them well in real-life situations where odds are manipulable, and misapply them to experimental settings. (shrink)

A long tradition suggests a fundamental distinction between situations of risk, where true objective probabilities are known, and unmeasurable uncertainties where no such probabilities are given. This distinction can be captured in a Bayesian model where uncertainty is represented by the agent’s subjective belief over the parameter governing future income streams. Whether uncertainty reduces to ordinary risk depends on the agent’s ability to smooth consumption. Uncertainty can have a major behavioral and economic impact, including precautionary behavior that may appear overly (...) conservative to an outside observer. We argue that one of the main characteristics of uncertain beliefs is that they are not empirical, in the sense that they cannot be objectively tested to determine whether they are right or wrong. The pioneering contributions of Bewley, Gilboa and Schmeidler highlighted important weaknesses in the foundations of economics and game theory. The Bayesian methodology on which these fields are based does not answer such basic questions as what makes beliefs reasonable, or how agents should form beliefs and expectations. Providing the initial impetus for debating these issues is a contribution that will have the lasting value it deserves.

We provide a simple model to measure the impact of aggregate risks. We consider agents whose rankings of lotteries over vectors of outcomes satisfy expected utility and separability. Such rankings are characterized in terms of aggregative utilities that measure sensitivity to aggregate uncertainty in a straightforward way. We consider applications to models of product variety, portfolio choice, and public attitudes towards catastrophic risks. The framework lends support to precautionary measures that penalize policies for exposure to correlation. In this article, I examine al-Ghazālī’s methodological skepticism and its role in establishing foundational knowledge.Despite the considerable scholarly attention given to The Deliverance from Error (al-Munqidh min al-ḍalāl), the foundationalism present in it has received relatively limited investigation. Al-Ghazālī established the foundations of knowledge by taking his methodological skepticism to its logical conclusions. His engagement with the sources of knowledge, namely, taqlīd, sense perception, and self-evident truths form the cornerstone of his skepticism. To understand how al-Ghazālī finds deliverance from his (...) skeptical impasse, and ultimately establish foundational knowledge, the concepts of “divine light” and fiṭra will be dis­cussed. Unlike Greek skepticism, al-Ghazālī’s skepticism was not a denial of the possibility of knowledge about the nature of reality, nor was it a denial of Muslim doctrine, but a methodological approach to establish the foundations of knowledge. Personal narratives in which medical students and clinicians reflect on their education and practice, or recipients of health care reflect on their journey though the system can provide valuable insights which can usefully be shared. In this paper, a medical student describes the effect of a humanities-based student-selected component on her understanding of anatomy and dissection, and a junior doctor in Iraq learns some painful lessons about medicine and society during a night shift in the casualty department.

Thereby, EIDs pose huge threats to health care infrastructures everywhere due to unprepared infrastructures and poor immunity levels of population. It discusses how key role players, the hospital administrator, would play a big role in managing EID infections as well as strategies related to infection control. Such vital factors include resource allocation, implementation of policies, training, and building a culture for safety as well as working under an interdisciplinary approach. COVID-19 pandemics are best used as case studies both where successes (...) occurred and where infection prevention lacked. Findings point toward robust surveillance, real-time data analytics, and the emotional support required for the healthcare workers involved in combating EIDs. The work discusses the socio-economic implications of EIDs and the utmost need to adapt strategies at resource-poor settings. Adding their recommendations with proper training, technological adaptations, and well-defined policymaking, they can decrease the impact of EID. By including technology, teamwork, and psychological impacts, the hospital administrators can develop such healthcare systems that can take on future challenges. AimThe aim of this study was to determine the presence of depressive symptoms and understand the potential factors associated with these symptoms among physicians in Bangladesh during the COVID-19 pandemic.MethodsA cross-sectional study using an online survey was conducted in between April 21 and May 10, 2020, among physicians living in Bangladesh. Participants completed a series of demographic questions, COVID-19-related questions, and the Patient Health Questionnaire-9. Descriptive statistics, test statistics were performed to explore the association between physicians’ experience of depression symptoms (...) and other study variables. Stepwise binary logistic regression was followed while conducting the multivariable analysis.ResultA total of 390 physicians completed the survey. Of them, 283 were found to be experiencing depressive symptoms. Predictors which were significantly associated with depressive symptoms were gender, the presence of sleep disturbance, being highly exposed to media coverage about the pandemic, and fear around COVID-19 infection, being assaulted/humiliated by regulatory forces and by the general public, while traveling to and from the hospital and treating patients during the countrywide lockdown.ConclusionThe findings of this study demonstrate that there is a high prevalence of depressive symptom among physicians especially among female physicians in Bangladesh during the COVID-19 pandemic. Immediate, adequate and effective interventions addressing gender specific needs are required amid this ongoing crisis and beyond. (shrink)

The _Epic of Gilgamesh_, a 3600-year 12-tablet collection, was looted from an Iraqi museum during the 1991 Gulf War, and fraudulently imported into the United States. In September, 2021, UNESCO facilitated its repatriation to Iraq, which is seen as an occasion to consolidate Iraq’s efforts to rebuild its legacy, since the _Epic of Gilgamesh_ is of immense cultural, historical and religious value for Iraq The current study examines the _Epic of Gilgamesh_ in the light of the ancient Sumerian and Akkadian (...) traditions. This collection of tablets carries a great legacy of the contemporary Babylonian and Mesopotamian beliefs and socio-religious values, also evident in the use of cuneiform and clay tablets, being ancient forms of writings. The study made use of content analysis and historical and analytical approaches to retrieve data through a documentation research design. The study found that the _Epic of Gilgamesh_ is not only a work of religious literature, but a treatise on civilization. On one hand it narrates the stories engrained in the Mesopotamian mythology, such as those of Ninsun, Shamash and Utnapishtim; on the other hand, owing to its content, literary style and tone, characterization and symbolism, this study would be a great contribution to relive the story of Gilgamesh from current literary, and socio-religious perspective and provide a comprehensive account of the legacy and inheritance that it brings in for the modern generation. The current study aimed to highlight the factors that may influence teachers' psychological resistance to digital technologies in entrepreneurship and business schools. Theoretically grounded in the diffusion of innovations theory and the theory of planned behavior, the current research investigates teachers' psychological resistance to digital innovation, school culture and climate, and moderation of teacher attitudes toward educational technologies. A cross-sectional field survey of 600 business and entrepreneurship school teachers was conducted in Jordan. In this study, partial least square-structural equation modeling (...) was used to assess the variables' “direct and moderating impacts” using the Smart PLS software 3.0. According to the results, school culture and school innovation climate had a considerable positive impact on teachers' resistance to digital innovation. Additionally, teachers' attitudes toward educational technologies moderated the relationship between study constructs in the framework. The study is a significant advance to the literature related to entrepreneurship, business education, and digital innovation. Organisations are increasingly involved in what they call ‘ethical dilemmas’, that is, the conditions under which wrongdoing and righteous deeds must be defined once again because the line between right and wrong has blurred more than ever. In general, human beings have special moral characteristics in the individual and personality dimension that shape their thoughts, speech and behaviour. It is possible that the same people in the same position and organisation could be affected differently, and their ideas, speech and behaviour (...) affect the efficiency and effectiveness of the organisation. Ethics can have positive or negative consequences at each organisational level. One of the effective factors on the occurrence of employees’ ethical behaviours is the role of spirituality in the work environment and humility of leaders. The purpose of this study is to investigate the effect of humility of Muslim leaders on the moral behaviours of followers and spirituality at work in Islamic society. The statistical population of the study was 370 Muslim employees of International Islamic University Malaysia. After distributing the questionnaires among the statistical population, 352 questionnaires were returned. The validity of the questionnaires was confirmed by the content validity method, and its reliability was confirmed by Cronbach’s alpha. In this research, the structural equation modeling approach and Amos software were used to analyse the data. All hypotheses were confirmed at a 95% significance level. The results showed that the humility of leaders has a positive and significant effect on spirituality in the workplace and work ethic of followers. Spirituality in the workplace has also a positive effect on employees’ work ethic.Contribution: It is recommended that the officials of organisations should pay attention to spirituality in the workplace and the humility of managers and supervisors towards employees in order to promote work ethics. Further, it can be concluded that organisations can increase the ethical behaviours of employees by promoting the components of organisational spirituality. (shrink)

This study examines the influence of the COVID-19 crisis on academic expectations among international students from north-western China. According to past studies, academic expectations are multifaceted, making it critical to test the methods employed to assess this fundamental trait. The outbreak of COVID-19 has resulted in various significant changes in education, which have shifted from traditional to online or mixed formats. As a result, examining international students' academic expectations along with their interactions with adopted technologies is a topic that addresses (...) the current situation and issues. A mixed approach, comprising two different instruments, was followed to achieve this primary objective. While a survey with a questionnaire was undertaken with 551 international students, divided into two groups, ten students were interviewed during and after the lockdowns. The findings revealed that COVID-19 had a significant impact on the academic expectations of students as well as many elements such as training for employment, personal and social development, international student mobility, motivation, social pressure, and social interaction with the help of supporting technologies. In terms of gender, men outperformed women in motivation, social interaction, training for employment, and personal and social development factors. Similarly, as per the grade variable, the same higher trend was seen in postgraduates. Based on these findings, a set of recommendations was put forward. In the future, technology will be helpful in China's educational sector, such as online group collaboration, open education, managing student retention, and supervising teachers' recruitment. Focusing on Abu Hamid al-Ghazali (d. 1111) - one of the foremost scholars and authorities in the Muslim world who is central to the Islamic intellectual tradition - this book embarks on a study of doubt (shakk) and certainty (yaqin) in his epistemology. Al-Ghazali (1058-1111) was concerned that early Islamic philosophers were leaning too heavily and uncritically on Aristotelian and Neoplatonic ideas in developing their models of God and His relation to the world. He argued that their views were not only irreligious, but philosophically problematic, and he defended an alternative view aimed at staying closer to the Qur’an and the beliefs of the ordinary Muslim. Although there are fundamental differences between Ahl al-Sunnah and Shī‘a on the issue of Mahdī, one of the controversial issues among Islamic sects, Shī‘a has attached much greater importance to the issue. In this study, after the information about Mahdiship in the primary sources of Islam is conveyed, the opinions of the Ahl al-Sunnah and Shī‘a will be given and an evaluation will be made about the evidence and opinions put forward by the two sects. The Shiites, who formed the (...) principles of belief based on the theory of imamate, explained the issue of Mahdism in the axis of imamate and gave it a religious dimension, but the Shi‘ī sects disagreed on the subject of Mahdī. Shi‘ī sources tried to show that the claim of Mahdiship is an important issue, which has preoccupied Muslims, by dating the claim of Mahdiship back to Ali ibn Abi Talib's son, Muhammad ibn Hanafiyah. In a very early period, it was claimed that Muhammad ibn Hanafiyya did not die but was still living on a mountain called Razva in Madinah, and he was the anticipated (muntaẓar) Mahdī. Most of the Zaydiyya did not consider the issue of Mahdiship an important fundamental basis of belief. Ismailiyya maintain that Muhammad ibn Ismail did not die and will come and amend the world one day. Imāmiyya believe that Hasan, whom they accept as the last imam, will reappear as the Mahdī in the latest days of the world, and in line with this belief, they have made great efforts to find proof from the Qur’ānic verses and hadiths and interpreted them. In this way, they attached more importance to the understanding of Mahdiship on the axis of imamate than the other Shi‘ī sects. According to Imāmiyya, since the world cannot be left without a prophet, an open, or a secret imam, Muhammad b. Hasan will remain hidden as long as he wants and appear as the Mahdī near the Doomsday. Based on the clear statement of the Messenger of Allah (pbuh) that twelve caliphs would come after him, the Imāmiyya restricted the number of Imams from Ahl al-Bayt to twelve and claimed that the twelfth imam would come again as Mahdī. Although the Imāmiyya believe that the Mahdī will be from the Ahl al-Bayt, just like the other imams, they have not been able to provide valid evidence for the belief that the twelfth imam will be hidden and appear near Judgment Day. Although Imāmiya tried/have been trying to prove that it is possible for a person to live for centuries (more than a thousand years), which is called al-Ghaybat al-Kubrā by Imamiyya, it cannot be said that they have succeeded in doing so. The primary objective of this research is to establish the extent to which small and medium-sized businesses (SMEs) in the Ha’il region benefit from a significant competitive advantage brought about by an entrepreneurial mindset (innovativeness, proactiveness, risk-taking, competitive aggressiveness, and autonomy). To achieve these objectives, the study used a questionnaire to collect data. A total of 220 SMEs in the Ha’il region were surveyed. The participants completed an online self-administered survey and used the PLS-SEM technique. The researchers found a robust (...) link between differentiation advantage and higher levels of innovativeness, proactiveness, risk-taking, competitive aggression, and autonomy. In addition, the outcomes of the survey reveal that a greater cost advantage is substantially associated with vastly greater innovativeness, proactiveness, risk-taking, and competitive aggression overall. However, cost advantage is not strongly correlated with autonomy. These findings are significant because they shed new light on how competitive advantages are formed through the entrepreneurial orientation of entrepreneurs in the Ha’il region. This is a significant theoretical contribution to the literature on entrepreneurial orientation, specifically in the context of SMEs. The findings may also be valuable in supporting SMEs in being successful by enhancing their competitiveness, as SMEs are key contributors to the development and growth of the economy. (shrink)

Construction cost estimation is one of the essential processes in construction management. Project cost is a complex engineering problem due to various factors affecting the construction industry. Accurate cost estimation is important in construction management and significantly impacts project performance. Artificial intelligence models have been effectively implemented in construction management studies in recent years owing to their capability to deal with complex problems. In this research, extreme gradient boosting is developed as an advanced input selector algorithm and coupled with three (...) AI models, including random forest, artificial neural network, and support vector machine for cost estimation. Datasets were gathered based on a survey conducted on 90 building projects in Iraq. Statistical indicators and graphical methods were used to evaluate the developed models. Several input predictors were used, and XGBoost highlighted inflation as the most crucial parameter. The results indicated that the best prediction was attained by XGBoost-RF using six input parameters, with r-squared and the mean absolute percentage error equal to 0.87 and 0.25, respectively. The comparison results revealed that all AI models showed good prediction performance when applied to datasets affected by more than two parameters. The outcomes of this research revealed an optimistic strategy that can help decision makers select the influencing parameters in the early phases of project management. Also, developing a prediction model with high precision results can assist the project’s estimators in decreasing the errors in the cost estimation process. (shrink)

This paper describes an intelligent algorithm for traffic sign recognition which converges quickly, is accurate in its segmentation and adaptive in its behaviour. The proposed approach can segment images of traffic signs in different lighting and environmental conditions and in different countries. It is based on using Kohonen's Self-Organizing Maps as a clustering tool and it is developed for Intelligent Vehicle applications. The current approach does not need any prior training. Instead, a slight portion, which is about 1% of the (...) image under investigation, is used for training. This is a key issue to ensure fast convergence and high adaptability. The current approach was tested by using 442 images which were collected under different environmental conditions and from different countries. The proposed approach shows promising results; good improvement of 73% is observed in faded traffic sign images compared with 53.3% using the traditional algorithm. The adaptability of the system is evident from the segmentation of the traffic sign images from various countries where the result is 96% for the nine countries included in the test. (shrink)

After the death of the Prophet, Muslims continued to apply the rulings deduced from the Qur'an and the Sunnah, and in matters they did not know, they turned to those who were more knowledgeable than themselves. As sects spread in the following period, some people saw this situation as taqlid and ignored the existence of sects. In the discussions that have continued until today, there are those who argue that the door of ijtihad is closed, as well as those who (...) want to expand the boundaries of ijtihad, especially during the periods of decline of Islamic countries. In the discussions that have continued until today, it has been stated that in order to achieve the bliss of this world and the hereafter, taqlid should be abandoned and the Prophetic teaching, which is universal, should be addressed one-to-one. Albānī (d. 1999), who lived in the last century, also put forward some views on the idea of ijtihad and taqlid. Although he opposed taqlid in general, he stated that scholars are tools guiding the Qur'an and Sunnah. Thus, he did not completely condemn taqlid, but criticised adherence to sects by stating that scholars should not be taken as a goal. According to Albānī, what is required for Muslims who cannot reach the level of ijtihad is not taqlīd but ittibā'. Therefore, to live and convey Islam, it should be communicated to both Muslims and non-Muslims not through sectarian perspectives, but by adhering to the SunnahAl-Albānī stated that the imams of the sects were not guilty of any offence in this matter and urged the jurists and mujtahids to act without adhering to a sect. However, the scholars affiliated to the sect thought that the ijtihad was hadith-centred and accepted following the sayings of the ulema of the past period within the sect as ittibā, not taqlid. However, al-Albānī acted consistently in his objections and criticisms and drew a moderate path for the reform of the ummah. Although some of his views portrayed him as an extreme scholar, he spent his life in the way of determining and understanding hadith and sunnah. (shrink)

Polygamy, which was practiced without limitations in the past, had been restricted to four wives after the arrival of Islam in the Arabian Peninsula. However, some scholars have different views on this issue, supposedly influenced by the literal and cultural background of patriarchal tradition on treating women as the object of polygamy. This article attempts to examine the construction of patriarchal interpretation in a gender-biased interpretation, its factors and its implications. This study adopts a qualitative approach and employs a content (...) analysis approach. Interviews with relevant scholars are also used to explore in-depth information regarding this subject. The object of research is based on a full set (30 juz /chapters) of 11 books of tafsir written in Indonesia. These books are Tafsir Al-Furqan, Tafsir Quran, Adz-Dzikra: Terjemah dan Tafsir al-Quran, Al-Quran dan Terjemahnya, Tafsir Quran Karim, Tafsir al-Azhar, Tafsir Rahmat, Tafsir al-Quran al-Majid an-Nur, Tafsir al-Mishbah, Al-Quran and its Exegesis of the Department of Religion, and Tafsir al-Hijri. This study found that women have been exploited through polygamy practices. Our findings show that biased gender interpretation, especially because of the patriarchal mindset, brought a greater impact on the Quranic interpretation. This study suggested that reinterpretation towards Quranic verses particularly dealing with gender issues needs to be strengthened in accordance with justice and humanistic values. Contribution: This article offered two approaches for the study of the Quran in order to establish gender equality and justice in marriage practice. Firstly, the adaptive and humanistic interpretations of the Quran need to be strengthened and should raise common consciousness in Muslim society. Secondly, there is a need to study the Quran in an integrative, holistic and hermeneutical understanding of the Quranic text. This method can explore the deepest meaning of the Quran so it can rise gender-sensitive, humanist and moderate interpretations. (shrink)

Nowadays, it is frequently seen that theology education is criticized over secularism or piety concerns. In fact, it has recently been observed that those who have opposed the existence of the theology faculties within the university system for religious reasons have tried to make their voices heard on different platforms, especially on social media. The discussions conducted on different platforms mostly run without a scientific basis. The aim of this study is to determine the views of theology faculty students with (...) regard to the studying on campus and to contribute to the structure of the evaluations on higher religious education-university dilemma on a scientific basis. Metaphor technique was used for data collection. Data were collected in April 2019 using open-ended questions from 228 sophomore, junior, or senior students at Faculty of Theology in Zonguldak Bülent Ecevit University. Content analysis and chi-square technique were used in the data analysis. The research revealed that the majority of students (%73, 2) produced positive metaphors for studying theology on campus. Students mostly explain the positive experience of studying on campus through the possibility of growing up as a well-equipped theologian, recognizing real-life, and representing religion. It was also determined that the students who completed the associate degree and continued theology faculty highlighted the positive aspects of theology education on campus.Summary: While higher education throughout history has been undertaken by madrasas in the East and monastic schools in the West, it has been represented by the modern university in the last two centuries. The madrasas and monastic schools were religious institutions in terms of aims, epistemological and pedagogical understanding, institutional structures, and the lifestyle they produced. The aim of these institutions, which are subordinate to religious authority, was to educate the man on behalf of God while giving this education in accordance with the religion. The university, which replaces madrasas and monastic schools, was not different from the tradition of madrasas and monastic schools when it was first established. The first universities and colleges that were accepted as the ancestors of the well-established universities in the West were schools established for religious purposes. Indeed, many of the western universities established in the past for religious purposes continue their administrative and financial ties with the church. On the other hand, after enlightenment, education has ceased to be a business of religious institutions, and national states have established modern universities to train people suitable for their own needs. The modern university that is positivist and rationalist reveals information to educate people and to perfect society in the name of the state and the economy, not for the God. Research shows that both universities that maintain their ties with the church and state universities participate in the secularization process deeply. Nevertheless, religion continues to exist in different forms at universities, which is much more intense at universities that continue their connection with the church. In addition to the theology and religious studies programs, religion finds a place in the modern university campus through accredited student organizations, campus priests and preachers, social organizations, etc.When Darülfünun (Dār al-Fünūn) the first example of a modern university was established in Turkey in 1900, theology faculty became one of the three faculties. However, whether a modern university is a suitable place for higher religious education has been a controversial issue. In 1915, theology faculty was removed from the university system, then re-established in the university again in 1924, and in 1933, theology education was terminated due to the discussions of modernization. In 1949, the theology faculty was reintroduced at the university; and after 1959, High Islamic Institutes were established under the Ministry of National Education. The inclusion of religious education in the university has been one of the issues that frequently occupy the agenda until 1982, when all higher religious education institutions were included in the university system. In these discussions, the interesting thing is that religious people insist on being included in the university system although various groups oppose in the name of secularism principle. Even more interesting is that there are still demands for higher religious education outside the university, although the number of theology faculties has increased in recent years. In order to make the madrasas to be function as an alternative or complement to theology faculty, they claim that the theology degree completion program or open theology program must be expanded. In fact, it has recently been observed that those who have opposed the existence of the theology faculties within the university system for religious reasons have tried to make their voices heard on different platforms, especially on social media. Those who make such claims, claim that the university is not a suitable place for religious education in terms of epistemology, pedagogy, and social life.This study aims to determine the views of theology faculty students with regarding to the studying on campus and to contribute to the structure of the evaluations on higher religious education-university dilemma on a scientific basis. Within this framework, three basic questions were investigated: (i) Do students highlight positive or negative aspects of theology education on campus? (ii) What kind of experiences are reflected on the positive or negative aspects of theology education on campus from the metaphors? (iii) Is there any difference among the metaphors of the students according to the gender and enrolling types to the faculty (university entrance exam or vertical transfer exam and non-exam enrolling system)? Metaphor technique was used for data collection. Data were collected in April 2019 using open-ended questions from 228 sophomore, junior, or senior students at Faculty of Theology in Zonguldak Bülent Ecevit University. Content analysis and chi-square technique were used in the data analysis.The research revealed that the majority of students (%73, 2) produced positive metaphors for theology education on campus. Students mostly explain the positive experience depending on the possibility of growing up as a well-equipped theologian, experiencing real-life, and representing religion. Among the reasons of the negative metaphor producers, the degenerative effect of the campus environment, the exclusion, and the desire to study in a religious environment come to the fore. It was also determined that the students who completed the associate degree and continued theology faculty highlighted the positive aspects of theology education on campus. Consequently, results show strong student support for theology education at university.In our opinion, it is possible to interpret the recent debates on the inclusion of theology faculties within the university system through the general tendencies of religious people who encounter modernism. In this regard, the results provide important clues. Religious people who encounter modernism generally preferred one of the following three ways: ghetto closure, conflict with the modern, seeking a consensus-based way to continue to touch the life of modern people with the message of religion over time and space. While those who prefer ghettos and conflict reject everything that is modern, those who are accommodating seek ways to keep religion together with modern people and institutions despite some risks. Results show that most of the theology students consider the university as a place that offers opportunities for religious education despite the secular and sometimes challenging environment of the campus. This means that they have a strong self-confidence in the beauty that religion can bring to modern life and modern people. (shrink)

Qurʾān was revealed to the Prophet Muḥammad (pbuh) not as a written document, but by word of mouth over a period of approximately 23 years. He dictated the verses to the scribes of revelation. After this, Abū Bakr compiled the written verses; i.e. gathered between two covers. Thus when the Qurʾān was compiled as a text, a number of addresses lost their characteristics. This situation, which is a result of the shortcomings in inscription, suggested the necessity of separating the verses, (...) preserving the recitation method (waqf places) learned from Prophet and transmitting the Qurʾān towards new learners. As a result, the science of al-Waqf and al-Ibtidāʾ has emerged. The systematics of al-Sajāwandī was chosen among the people who systematized the waqfs marks and the mushafs that we have today are arranged according to the systematics of al-Sajāwandī. At this point, the issue of showing other addressing features of the Qurʾān, such as the emphasis, in text appeared as an area that to be considered. The aim of this study is to analyze this issue and to focus on the possibility and method of realizing the subject. If punctuation marks are to be added to the Qurʾānic text, this should be done by taking into account the characteristics of punctuation marks in Arabic. According to comparison between punctuation and wakf marks, it was seen that they have different characteristics. First difference is the systematic difference. Punctuation marks in modern Arabic script are divided into four groups: end marks, tone marks, quotation marks, and the signs used in mathematics. However, al-sajawānds consists of only end/stop marks. In this case, al-sajawānds do not function as punctuation marks indicating tone of voice/emphasis and quotations. The second difference is that punctuation marks are more about the meaning than waqf marks. Because waqf marks do not oblige reader to understand only one of the possible meanings. However, punctuation marks limit or even determine the meanings. In addition, waqf marks are also based on the recitation(s) of the Prophet/al-qirāʾat al-manqulah. Correct comprehension depends on correct reading. For correct reading, addressable features must be able to be incorporated into the text as much as possible. Today’s muṣḥaf, cannot show emotions, emphasis to the reader. Beside, each of the characteristics of waqf marks (al-waqf al-muʿānaqah ext.) cannot meet the end marks found in today’s punctuation marks. In this case, we can add emphasis marks to text in order to reflect the emphasis that are missing from them by keeping al-sajāwands. Likewise, the question of to where/whom the word belongs to, which may cause confusion in text, can be resolved with quotation marks. Hereby, it has been concluded that a pseudonym system that can reflect the emphasis features of the Qurʾān and show quotations, should be developed in addition to al-sajāwands. So, our proposal includes the following steps: keeping al-sajāwands existing in the muṣḥaf; placing the emphasis marks in today's punctuation marks, which will serve this function in places where the emphasis and tone of prayer’s voice cannot be reflected in writing; putting quotation marks. Thus, it will be possible to develop a system that can show the linguistic, grammatical, semantic, phonetic, emotional and reciprocity dimensions of address in the writing/text. In this context, the punctuation marks that we find useful to be added to the muṣḥaf are emphasis marks (:!؟) and some quotation marks («»: -). قَالَ فَمَنْ رَبُّكُمَا يَا مُوسٰى؟ قَالَ رَبُّنَا الَّذ۪ٓي اَعْطٰى كُلَّ شَيْءٍ خَلْقَهُ ثُمَّ هَدٰى. Tāhā 20/49-50 As an example, in this verse, there is a real question that is expected to be answered. Then a question mark can be put at the end of this sentence. In addition, a dot mark can be placed at the end of the answer sentence to indicate that the answer is concluded. (shrink)

Bu çalışma, geleneksel din felsefesindeki kötülük probleminin gerçek değil sözde bir problem olduğunu, dolayısıyla çözümlemeye çalışmak yerine tasfiye edilmesi gerektiğini öne süren bazı yeni tarihli iddiaları değerlendirmektedir. Öncelikle ele alınan konu sözde problem dendiğinde ne kastedildiğidir. Bir problemin iki tarafının karşılıklı olarak aynı yanlış varsayımı yaptığı durumlar literatürde sözde problem olarak nitelendirilmektedir. Makalede bu anlamda sözde problemin türleri ve ölçütleri belirlenmektedir. Arkasından geleneksel kötülük problemini oluşturan argüman ortaya koyulmakta ve problem için getirilen çözüm önerileri tanıtılmaktadır. Makalenin son bölümünde, önceki bölümlerde (...) tanıtıldığı şekliyle kötülük probleminin, önceki bölümlerde tanıtıldığı şekliyle sözde problem ölçütlerini karşılayıp karşılamadığı incelenmektedir. Varılan sonuç, kötülük problemine yönelik sözde problem iddialarının savunulabilir olmadığı, problemi tasfiye etmek için ortada sağlam bir gerekçe bulunmadığıdır. (shrink)

Deism, which is known for denying the belief in prophethood and the hereafter while accepting the existence of a deity who is understood through reason but does not interfere with the universe while, has gained increasing popularity especially in positive scientific circles in Europe with the Enlightenment period. The development of deism in Europe has been significantly influenced by the ideas of philosophers and scientists such as Descartes, Newton, Voltaire, David Hume, and Kant. Although there is no word in Islamic (...) terminology that corresponds with the meaning of deism, terms such as Dahriyya, Barāhima, ilhad and heresy have been used to refer to different types of denial, including deism and atheism. However, it can be said that “Dahriyyah” is closer to atheism in meaning, while “Barāhima” is used in a more specific sense to deny prophethood. The words “ilhad” and heresy are used to express any kind of denial that rejects the principles of Islam. Parallel to deism being a subject of interest in our country and around the world, there has been a significant increase in studies conducted both in favour and against it. In this article, the rational proofs mentioned by Māturīdī regarding the existence of the hereafter, which deism rejects, have been discussed. In particular, the evidence found in the exegesis of relevant verses of the Qur’ān in Kitab al-Ta’wilat have been subject to examination. Māturīdī has emphasized the importance of providing rational proof for those who do not believe in the Qur’ān, stating that they will not accept any evidence derived from it. Māturīdī, who researched the reasons why people deny the afterlife, explained that people’s attempt to understand everything by comparing them to their own abilities is an important reason for the denial of the afterlife. According to him, people deny the afterlife because they believe that the power to resurrect the dead is beyond their own abilities and assume that their power is not enough for such an act. If they had contemplated the creation of the heavens and the earth, they would have realised that Allāh’s power is different from the power of His creatures. Furthermore, Imam Māturīdī pointed out that it would be absurd and pointless for Allāh, the Creator of the universe, to have created it solely for the purpose of its destruction. He emphasised that there must be a purpose for its creation, and that this purpose indicates the existence of the afterlife, where the actions of the created beings will be accounted for. In addition, Māturīdī, who said “If the world was eternal, it would not be possible to repay the deeds done,” emphasised the necessity of distinguishing between virtuous and evil individuals and giving everyone the reward or punishment they deserve. He acknowledged that human beings live in this world as a test, and the true consequences of their actions will be revealed in the hereafter. (shrink)

Türk kültür ve inanç tarihine bakıldığında, Türk milletinin doğa ile uyum içinde yaşadığını ve bu yaşam biçimini sürekli kılmayı amaçladığını gösteren pek çok bulgu mevcuttur. İslam öncesi Türk toplumlarında olduğu gibi, kitlesel olarak İslam dinini benimsemesinden sonra da bu yaklaşımın sürdürüldüğü görülmektedir. Bu çalışmada kadim Türk kültürünün ve İslam inancının, insanlara verdiği çevreye ilişkin değer yargıları ve davranış modelleri biyoetik kavramı çerçevesinde ele alınmıştır. Bu amaçla öncelikle eski Türk inançları, arkeolojik bulgular, metinler, destanlar incelenmiştir. İslam inancının Türklerin çevre algısına etkilerini (...) tespit edebilmek için ayet ve hadislerdeki çevreye yaklaşım örnekleri ele alınarak Müslüman Türklerin kültürel unsurlarında İslami anlayışın çevreyle kurulan ilişkiye yansımaları araştırılmıştır. Bu yolla elde edilen bulgular, çevrebilim literatüründeki biyoetik kavramıyla değerlendirilmiştir. Sonuç olarak Türklerin gerek İslam öncesi gerekse İslamiyet’i kabullerinden sonraki doğa ve evren anlayışlarının, insanı bunların üstünde değil bir parçası olarak kabul ettiği ortaya konulmuştur. Farabi defines “Ilm al-Hiyal” in Ihsa al-Ulum as “knowing a way by which, human can adjust all of the concepts that have been proved in mathematics with verification to exotic objects, and helps their states in exotic objects to be carried”. He believes this will be recognized and be attained by craft. This was the common view in Islamic wisdom and philosophy in third and fourth Hijra centuries. Researchers believe that the unique emphasis on parallelism between theoretical science and practical (...) work is an important feature of Baghdad school and affected Islamic visual culture. Baghdad school had been affected by translation. In this way, Ikhwan-al-Safa, whom wrote the first encyclopedia of science in Islamic culture, had a very efficient role. They devised geometry into intellectual and sensual ones in the second part of their book, al-Rasa-el, and considered intellectual geometry as one of the middle philosophy and recognition and understanding factor for meaning of sensual geometry evidences. They insisted on basic situation of intellectual geometry in guidance of whom, want to learn intellectual things from sensual ones. They knew intellectual geometry as the factor for requiring skill in scientific crafts, and sensual geometry as the factor of practical crafts, and made a vast relation between them. They also defined end of intellectual geometry understanding the base of all sciences and the main factor of wise, essence of self. Important feature of Ikhwan-al-Safa’s wisdom is omitting the gap between theory and practice, making a vast relation between them, which affected the meaning of crafts in Islamic culture, and rendered a spiritual feature to crafts and arts. It seems this relation has created the concept of traditional arts, and integrating wisdom and crafts in Iranian-Islamic culture constructed all of the Fotowat-Nam e. This article reviews the concept, which affiliates theory and practice in third and fourth centuries and has a deep effect on recognition of art and craft in Islamic culture. (shrink)

“Dünyadaki kötülüklerin varlığı, geleneksel teizmdeki Tanrı inancı için bir problem oluşturur mu?” 2000 yıldan fazla zamandır çok çeşitli geleneklerden gelen düşünürleri meşgul eden bu çetrefilli soruya bu kitap, en güncel tartışmalardan hareketle cevap vermeye çalışıyor. Kötülük probleminin tarihsel gelişimini, mantıksal ve delilci kötülük argümanlarını özetledikten sonra kitap, geleneksel ve modern teist çözüm önerilerini ele alıyor: Özgür iradenin varlığı veya manevi gelişim potansiyeli, kötülüklerin varlığını meşru hâle getirir mi? Etrafımızda gördüğümüz kötülüklerin gerekçesi konusunda şüpheci tavır takınıp Tanrı'nın hikmetinin, insanın kısıtlı zihni (...) tarafından sorgulanamayacağı sonucuna mı varmalıyız? Özel olarak İslami gelenek içinde kötülük problemini çözmemizi sağlayacak kaynaklar bulabilir miyiz? Kitap, tüm bu önerilerin yetersiz kaldığını iddia ederken karşı cevap olarak modern "kötü tanrı" argümanını ele alıyor. Buna ek olarak ilahi adaleti tehdit eden ilahi gizlilik ve benzeri argümanlar, kötülük problemini daha da çözümsüz hâle getiriyor. Kötülük probleminin çözümsüzlüğü, evrenin bizim acılarımıza ve isyanımıza kayıtsız olduğu ihtimali ise bizi daha üst düzey bir probleme, anlam problemine taşıyor. Anlam problemi, herkesin problemi olduğuna göre kötülük karşısında kimsenin rahat olmaması, anlamlı hayat konusunda herkesin kafa yormaya devam etmesi gerekiyor. (shrink)

Kelâm’ın şerh ve hâşiye döneminin önde gelen metinlerinden biri Teftâzânî’nin Şerhu’l-Akāid adlı şerhidir. Nitekim üzerine İslâm dünyasının muhtelif bölgelerindeki âlimler tarafından birçok hâşiye çalışması yapılmıştır. Bunlar arasında öne çıkan en meşhur metinlerden birisi Hayâlî’nin yazmış olduğu Hâşiye alâ Şerhi’l-Akāidi’n-Nesefiyye adlı eserdir. Nitekim Hayâlî’nin bu hâşiyesi, Şerhu’l-Akāid üzerine yazılan hâşiyeler arasında üzerine en fazla hâşiye yazılan eserdir. Kâtib Çelebi, Leknevî ve Taşköprülüzâde gibi âlimler Hayâlî hâşiyesi hakkında övücü ifadeler kullanmıştır. Ayrıca Hayâlî’nin bu hâşiyesi Osmanlı kelâm kitapları hiyerarşisinde Şerhu’l-Akāid’den daha üst bir (...) metin olarak değer görmüştür. Bu kadar ilgi gören bir hâşiye hakkında Kâtib Çelebî’nin zikrettiği bir iddia dikkat çekmektedir. Kâtib Çelebî, Hayâlî hâşiyesinin kaynağının Memlük ulemasından İbn Ebî Şerîf’in Şerhu’l-Akāid hâşiyesi olduğu hakkında bir bilgiye yer vermektedir. Dolayısıyla Hayâlî, hâşiyesini İbn Ebî Şerîf’in hâşiyesinden alıntı yaparak kaleme almış olabilir. Bu iddianın tahkik edilmesi çalışmanın temel konusunu oluşturmaktadır. Bunu yaparken iki muhaşşînin yaşadıkları ve eserlerini kaleme aldıkları zaman dilimi göz önünde bulundurulmuştur. Diğer taraftan iki hâşiyenin muhteva analizinin yapılması da iddianın tahkik edilmesi için temel bir ölçüt konumundadır. Böylece ana konu bazında benzerlikler ve farklılıklar ortaya konularak iki hâşiyenin karşılaştırılmasına olanak sağlanmıştır. Muhteva analizinde eşyanın hakikatleri, ilim sebepleri, âlemin temel bileşenleri, Allah’ın sıfatları, rü’yetullah, insan fiilleri ve ahiret hayatı ile ilgili meseleler olmak üzere yedi konu başlığı tercih edilmiştir. Bu başlıklar altında konular detaylı bir şekilde aktarılmayıp yalnızca benzerlikler ve farklılıkların ortaya konulabilmesi için seçme pasajların verilmesi yeterli görülmüştür. Çalışmada yöntem olarak doküman çözümlemesi/analizi kullanılmıştır. Sonuç olarak bu iddia tahkik edildiğinde durumun Kâtib Çelebî’nin aktardığı gibi olmadığı tespit edilmiştir. Nitekim iki muhaşşînin doğum ve ölüm tarihleri diğer taraftan hâşiyelerini yazım tarihleri incelendiğinde bu iddianın mümkün olmadığı ortaya çıkmıştır. Hayâlî hâşiyesini yaklaşık olarak 862/1458, İbn Ebî Şerîf ise 889/1484 veya 895/1490 yılında kaleme aldığı tespit edilmiştir. Dolayısıyla tarihsel olarak Hayâlî’nin İbn Ebî Şerîf’ten alıntı yapması mümkün görünmemektedir. Kâtib Çelebî’nin aktardığı bilginin yanlışlanması tam tersi bir durumun olma ihtimalini gündeme getirir. Yani İbn Ebî Şerîf, hâşiyesini yazarken Hayâlî’den faydalanmış olabilir. Bu düşüncenin doğrulanması veya yanlışlanması için her iki hâşiye arasında muhteva analizinin yapılması gerekmiştir. İki hâşiyenin muhtevaları karşılaştırıldığında ise büyük oranda benzerliklerin olduğu görülmüştür. Öyle ki bazı yerlerde cümleler birebir aynı iken bazı yerlerde benzer ifadeler kullanılmıştır. Ancak İbn Ebî Şerîf’in hâşiyesi Hayâlî’nin hâşiyesine göre daha uzundur. Öyle görünüyor ki İbn Ebî Şerîf hâşiyesini, Hayâlî hâşiyesi temelinde inşa etmiştir. (shrink)

The main evidence used in a matter of proving prophethood in Kalām is miracles. For this reason, other extraordinary situations that miraculously occur have always been on the agenda of theologians. Of these the most similar to miracle is karāma events that occur extraordinary in the hands of Walī. Karāma has been discussed on certain theoretical grounds in kalām books during the beginning period of Sunnī kalām. As in other theological debates, the leading adversaries of Sunnī theologians in the issue (...) of karāma were Muʿtazilite theologians. This study discusses approaches towards karāma in early period of Sunnī kalām. Accordingly, the scholars who determined the basic approaches of Ashʿariyya and Māturīdiyya kalām schools are included in the study. İmām al-Ashʿarī, Ibn Fūrak, al-Bāqillānī, ʿAbd al-Qāhir al-Baghdādī, Abu’l-Maʿālī İmām al-ḥaramayn al-Juwaynī, Abū ʿAbdallāh al-Ḥalīmī and Abū Isḥāq al-Isfarāyīnī from Ashʿarī school; Abū Manṣūr al-Māturīdī, Ḥakīm as-Samarqandī, Abū al-Yusr al-Bazdawī and Abū al-Muīn an-Nasafī from Māturīdiyya school, in this context, are included in the study. Besides, some authors from fields other than kalām are included in the scope of the study in order to determine the first use of the concept of karāma and different approaches are discussed. In the study, after the views of the theologians on the subject are presented descriptively, these views are critically assessed. (shrink)

Bu makalede İşrakî felsefe geleneğinin önemli bir düşünürü olan İbn Tufeyl’in, Hayy b. Yakzan isimli eserinde ortaya koymuş olduğu dini tecrübeyi ve mahiyetini ele aldık. Konuyu temellendirmek için öncelikle dini tecrübeden ne anladığımızı ve çeşitlerinin ne olduğunu tespit etmeye çalıştık. Daha sonra İbn Tufeyl’in felsefi ve teolojik arka planının ne olduğunu tespit ettik. Burada kilit rolü, İbn Sina oynamaktadır. Ancak Sühreverdî’nin görüşleri de önemli bir yer tutmaktadır. İbn Tufeyl’in en önemli kaynaklarından biri şüphesiz Gazzâlî’dir. Ancak İslam tasavvuf geleneğinde dînî tecrübe (...) konusu farklı çalışmalarda ele alındığı için Gazzâlî düşüncesine yer vermedik. Sonuç olarak İbn Tufeyl, doğal teoloji üzerinden felsefi bir dînî tecrübeyi konu edinmektedir. (shrink)

Games are among cultural manifestations of human communities which have continued to exist since the ancient times and developed during peaceful times; in the Qajar era, during the reign of Nasser-al-Din Shah, because relative peace and prosperity was brought about, the people, especially courtiers, showed great interest in games and spent some of their daily life on it. In this article we have attempted to present some of the angles and dimensions of a number of these games using the itineraries (...) of orientalists and histories and works of that period. In this regard, we have borne in mind time, venue, extensiveness, customs and the reflection of these games in literature and based on evidences demonstrated that Qajar era is one of the most prominent periods in Iranian history and culture regarding the diversity and colorfulness of these games. Skillfulness of game players, large bets, struggles and arguments between opponents, special formalities, etc., are all the criteria for the acceptability and popularity of games in this age, which have been put into consideration. Nowadays, higher education worldwide is affected by the COVID-19 pandemic. It has affected students’ attendance in the universities and causes universities to close down in more than 190 countries. On the other hand, novice engineers studied only a few lectures related to highway engineering. Their lectures have included very little knowledge about asphalt pavement construction as highway engineering consists of many areas that are not studied in detail during their studying years subject to their traditional education. Due to all mentioned, (...) a new drive to promote online learning paves the way to evaluate our future approach to curriculum development and delivery of educational materials for engineering courses. However, experts can offer solutions to these problems using their past experience. Hence, a system that allows experts to share their experience with other engineers after completing a project is needed. Nevertheless, the web-based expert system for maintaining flexible pavement problems in tropical regions designed in this study is a novel concept. Prior to developing this system, the need for such a system was determined through literature review and validated through a questionnaire survey. Experts were interviewed, and a questionnaire survey was conducted to construct the knowledge base of the system. Knowledge was presented as rules and coded in software through PHP programming. Web pages that support the user interface were designed using a framework that consists of CSS, HTML, and J-Query. Furthermore, the system was tested by an array of users engaged in highway engineering, namely, experts, teaching experts, novice engineers, and students. The mean values of the overall system evaluation performed by 20 users using a five-point Likert scale were 4, 4.5, 3.75, 4.25, 5, 4, and 3.5. Expert and user satisfaction prove the effectiveness of the proposed system. (shrink)

In 2017, the blockade of Qatar Gulf states caused a plethora of effects on the country. This paper sought to examine the resulting threat effects of this blockade in terms of lowered self-esteem and well-being, and the potential buffering effects of an overarching identity. Using self-report questionnaire data from Qatari secondary school students, multiple moderated mediation models investigated the predictive effects of youngsters’ perceived threat, via self-esteem, on their well-being, and the mitigating roles herein of, respectively, national, Gulf region, and (...) Arab identity. Perceived threat was indeed related to lower well-being via lower self-esteem, and this relationship was equally strong for those low and high in social identity. In terms of the three facets of identity, the overarching Gulf identity seems the most predictive, and it even buffers the negative relationship between threat and reduced self-esteem. (shrink)

Resistance towards non-Muslim leaders emerged when the case of blasphemy against Islam was brought against Basuki Tjahya Purnama, known as Ahok, as the governor of DKI Jakarta at that time (DKI Jakarta is mostly inhabited by Muslims). The case of blasphemy committed by Ahok has triggered the resistance of Muslims towards non-Muslim candidates for the regional leader election. This study uses a cross-sectional design conducted by interviewing 1121 Muslim youths who participated in regional head elections in North Sumatra. Multivariate analysis (...) in this study used a logistic regression test with JAPS 16 software. The results of this study indicate that Muslim youth in North Sumatra province have high resistance to non-Muslim candidates for regional heads (governor and mayor). Hifz Al-Din [maintaining religion] (p < 0.001; Exp [β] = 2.505) is seen to affect the resistance of Muslim youth to non-Muslim governor candidates; Hifz Al-Din (p < 0.001; Exp [β] = 2.053) is seen to affect the resistance of Muslim youth to non-Muslim mayoral candidates; Hifz Al-Ummah [developing national integration] (p = 0.001; [β] = 2.194) is seen to have influenced the resistance of Muslim youth to non-Muslim governor candidates; Hifz Al-Ummah (p = 0.011; Exp [β] = 1.800) affects the resistance of Muslim youth to non-Muslim mayoral candidates. Muslim youth have high resistance to non-Muslim leaders when participating in elections. Muslim youth are afraid that prospective non-Muslim leaders will make various policies that will make it difficult for Muslims to carry out various kinds of worship performed by Muslims. CONTRIBUTION: This study is expected to provide information for non-Muslim leader candidates about the fear of Muslim youth against non-Muslim candidates for the regional leader election, especially regarding the policies to carry out worship for Muslims and to maintain the unity of the Ummah. Hukuk düzeninin kişiye bahşettiği haklar, iktisadi değer taşıması yönünden “malvarlığı hakkı” ve “şahıs varlığı hakkı” şeklinde esaslı bir ayrıma tabi tutularak incelenmektedir. İktisadi değer taşıyor olması yönüyle şahıs varlığı haklarından farklılaşan malvarlığı hakları, herkese karşı ileri sürülebiliyor olması durumunda “mutlak”, yalnızca borçlu namındaki yükümlüye karşı ileri sürülebiliyor olması halinde ise “nisbî” şeklinde nitelenir. Mutlak mamelek hakları somut bir kütleye sahip olan (cismanî) bir konu üzerine kuruluysa aynî hak adını alır. Aynî haklar, nisbî özellik taşıyan ve dolayısıyla belirli bir şahsın edimi (...) sayesinde ve ancak onun aracılığıyla kullanılan alacak haklarıyla birlikte malvarlığının iki önemli bileşenini oluşturur. Tarihsel süreçte bu iki hak türünü birbirine yaklaştırmaya yönelik çeşitli teşebbüslerde bulunulmuşsa da bu haklar gerek mahiyet gerek hüküm itibariyle farklı kabul edilmeye devam etmiştir. Söz konusu farklılık, hakkın konusu üzerindeki hakimiyetin şekli yani doğrudan veya dolaylı olması bakımından, bahse konu hakların eşyanın aidiyetine etkisi açısından, hakkın mutlak veya nisbî olması cihetinden, sürekli olup olmama yönünden ve makalede etraflıca ele alınacağı üzere öncelik/üstünlük itibariyle ortaya çıkmaktadır. Kara Avrupası hukuk sistemine ait olan bu kavramsal kurgu ve terimlerin muadillerine veya benzerlerine İslam hukuk doktrini içerisinde de rastlanmaktadır. Bu kapsamda fıkıh literatüründe malvarlığı haklarının tümüne şamil olacak şekilde “milk” terimi kullanılmış, hakkın konu edindiği varlığın niteliğine göre de “milkü’l-ayn”, “milkü’l-menfaa”, “milkü’d-deyn”, “milkü’l-habs ve’l-yed” gibi terimler geliştirilmiştir. İnsanlar arasındaki hukuki menfaatlerin karşı karşıya geldiği bazı durumlarda bu iki hak türü arasında tercih yapmak gerekebilmektedir. Bu tarz bir tercih durumunda aynî haklara, ihtiva ettiği yetkiler dikkate alınarak şahsî haklar karşısında bir tür öncelik tanınmıştır. Söz konusu önceliğin en belirgin şekilde görüldüğü yerlerden biri de kiraya verilen malın kira akdi devam ettiği sırada üçüncü kişilere devredilmesidir. Bu noktada İslam hukukunda kira akdinin kişiye kazandırdığı yetkiler Kara Avrupası hukuk sistemine göre farklılık arz eder. Makalede kiracının bu hakkının İslam hukukuna göre -Kara Avrupası hukuk sisteminden farklı olarak- aynî nitelikte kabul edildiği savunulmaktadır. Bunu temellendirmek için kiralanan malın kira müddeti içerisinde üçüncü şahıslara satılması, kiralanması veya gasp gibi haksız fiil şeklinde yorumlanabilecek yollarla intikal etmesi halinde fıkıh doktrininde kiracıya tanınan yetkiler incelenmiş İslam hukukunun bu hususlardaki özgün yaklaşımı klasik ve modern fıkıh eserleri dikkate alınarak, Türk hukukuyla da kıyaslamalar yapmak suretiyle ifade edilmiştir.
